These SMS Terms of Service (“SMS Terms”) govern your participation in the Powerfull Solar, Inc. (“Powerfull Solar,” “we,” “us,” or “our”) text messaging program (the “Program”). By providing your mobile phone number and affirmatively opting in, you agree to these SMS Terms.

These SMS Terms are intended to comply with the Telephone Consumer Protection Act (TCPA), the CTIA Messaging Principles and Best Practices, and A2P 10DLC carrier requirements.

2. Program Description

When you opt in, Powerfull Solar may send you SMS and MMS text messages related to your relationship with us. This is a mixed-use program that may include:

Conversational and customer care messages:

  • Responses to a quote request or consultation inquiry you submitted
  • Scheduling, confirming, and reminding you of consultations, site assessments, and installation appointments
  • Questions from our team about your property, roof, or utility usage
  • Status updates on system design, financing, permitting, inspection, and Permission to Operate
  • Service, maintenance, and system monitoring notifications
  • Billing and account notifications

Promotional messages:

  • Information about solar products, financing options, tax credit deadlines, and seasonal offers

You may receive messages from a live representative or from an automated system.

3. How You Opt In

You may opt in to the Program through any of the following methods:

  • Website form. Submitting a form on https://www.powerfullsolarinc.com/ (including the quote request form at https://www.powerfullsolarinc.com/get-a-quote/) and checking the separate, unchecked consent box authorizing text messages.
  • Verbal consent. Providing your mobile number and verbally agreeing to receive text messages during a phone call or in-person consultation with a Powerfull Solar representative. Verbal consent is documented in our customer record.
  • Written consent. Signing a paper or electronic form that includes text messaging consent language.
  • Text keyword. Sending a text message to 310-804-7617 or to any Powerfull Solar number, which initiates a conversation and constitutes consent to reply.

Consent to receive text messages is not a condition of purchasing any goods or services from Powerfull Solar.

The consent language presented at the point of opt-in reads substantially as follows:

By checking this box, you agree to receive text messages from Powerfull Solar at the phone number provided. Message frequency varies. Message and data rates may apply. Reply STOP to opt out or HELP for help. See our Privacy Policy and Terms of Service.

4. Message Frequency

Message frequency varies and depends on your interaction with us and the stage of your project. You may receive more frequent messages during an active consultation, installation, or service window.

5. Message and Data Rates

Message and data rates may apply. Any charges are billed by and payable to your mobile service provider. Please contact your wireless carrier for details about your messaging plan. Powerfull Solar is not responsible for charges imposed by your carrier.

6. How to Opt Out

You can cancel the Program at any time. Reply STOP, END, CANCEL, UNSUBSCRIBE, or QUIT to any message you receive from us.

After you send one of these keywords, we will send you a single confirmation message acknowledging that you have been unsubscribed. After that message, you will no longer receive text messages from Powerfull Solar unless you opt in again.

You may continue to receive messages for a short period while we process your request. You may also opt out by calling 310-804-7617 or emailing info@powerfullsolarinc.com.

If you want to rejoin the Program, simply opt in again using any method described in Section 3.

Our messaging platform may not recognize requests that modify these keywords. You agree that we and our service providers are not liable for failing to honor requests that do not comply with the requirements in these SMS Terms.

Reply HELP to any message you receive from us and we will respond with contact information and support instructions.

8. Privacy and Data Sharing

Your privacy matters to us. Our full Privacy Policy is available at https://www.powerfullsolarinc.com/privacy-policy/.

No mobile information will be sold, rented, or shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties.

Mobile phone numbers and SMS consent are used solely for communication between you and Powerfull Solar. We do not purchase mobile numbers or SMS consent from lead vendors, list brokers, aggregators, or any other third party, and we do not send text messages to any number that has not directly provided consent to Powerfull Solar.

The only parties with access to your mobile number in connection with the Program are the messaging service providers and carriers that transmit our messages on our behalf. These providers are contractually restricted to using that information solely to deliver messages for Powerfull Solar and may not use it for their own marketing purposes.

9. Eligibility

You must be at least 18 years of age and a resident of the United States to participate in the Program. By opting in, you represent that you are the account holder of the mobile number provided or that you have the account holder’s permission to enroll that number.

If your mobile number changes or is reassigned, you agree to notify us promptly by replying STOP or contacting us using the information in Section 1.

10. Supported Carriers and Delivery

The Program is available on most major United States wireless carriers, including AT&T, Verizon Wireless, T-Mobile, Sprint, Boost, Cricket, MetroPCS, U.S. Cellular, Virgin Mobile, and others.

The Program is offered on an “as is” basis and may not be available in all areas, at all times, or on all mobile carriers. Carriers are not liable for delayed or undelivered messages.

You agree that neither Powerfull Solar nor our service providers will be liable for any failed, delayed, or misdirected delivery of any message or information sent through the Program.

11. Changes to the Program

We may modify or cancel the Program or any of its features at any time, with or without notice. We may also change the telephone number we use to operate the Program, and we will notify you of any such change.

You acknowledge that requests sent to a telephone number that has been changed may not be received by us, and we will not be responsible for failing to honor a request sent to a changed number.

To the extent permitted by applicable law, we may modify these SMS Terms at any time. Any changes will be posted at this URL with an updated Last Updated date. Your continued participation in the Program after changes are posted constitutes acceptance of the revised SMS Terms.

12. Disclaimer of Warranty

The Program is provided on an “as is” and “as available” basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

13. Governing Law

These SMS Terms are governed by the laws of the State of California, without regard to its conflict of law provisions. Any dispute arising out of or relating to the Program shall be brought in the state or federal courts located in Los Angeles County, California.
